T.C. Ulaştırma ve Altyapı Bakanlığı ALO 123 Sistemi Aydınlatma Metni
Bu Aydınlatma Metni, 6698 sayılı Kişisel Verilerin Korunması Kanunu’nun “Veri Sorumlusunun Aydınlatma Yükümlülüğü” kenar başlıklı 10 uncu maddesi uyarınca ve Kişisel Verilerin Korunması Kanunu kapsamında veri sorumlusu olan T.C. Ulaştırma ve Altyapı Bakanlığı (Bakanlık) tarafından, mobil uygulama (ALO 123) kullanıcılarına, kullanıcılara ait kişisel veriler hususunda bilgilendirme yapmak amacıyla hazırlanmıştır. Kişisel Verilerin Korunması Kanunu uyarınca veri sorumlusu sıfatını haiz Bakanlığın merkez adresi “Hakkı Turayliç Cad. No:5 Emek Çankaya/ANKARA” dır.
Veri Sorumlusunun Kimliği
Bu sistemde işlenen kişisel verileriniz bakımından veri sorumlusu T.C. Ulaştırma ve Altyapı Bakanlığı’dır.
Kişisel Verilerin İşlenme Amacı
Bu sistemde; Adı, soyadı, iletişim, cinsiyet, engel durumu, eğitim durumu, adres, görüntü, ses ve konum bilgileri kişisel verileriniz şu amaçlarla işlenmektedir: Sizlere doğru hitap edilebilmesi, aramanın teyidi, arama sayısının istatistiksel tespiti, vatandaş bildirim süreçlerinin yürütülmesi, iş faaliyetlerinin yürütülmesi/denetimi/analizi/raporlanması/izlemi, talep/şikayetlerin takibi, bilgi/danışma hizmeti temin süreçlerinin yürütülmesi, bir sonraki hizmet talebinizde profil kaydınızı hazır bulundurmak, acil durum bildirimlerinizde adresinizin tespiti, hizmeti alan ve veren kişilerin işlem güvenliğinin yürütülmesi, kurumun hizmet temini sürecinin yürütülmesi ve ileride doğabilecek uyuşmazlıklarda delil olarak kullanılması amaçlarıyla Kişisel Verilerin Korunması Kanunu’nda belirtilen mevzuata uygun olmak şartı ile işlenmektedir. Konum verisi, sadece anlık olarak kullanılmakta, kayıt altına alınmamaktadır. Konum servislerinizin kapalı olması halinde konum bilginiz işlenmemektedir.
Kişisel Verilerin Aktarımı
Talebiniz ve uygulamayı kullanımınız ile ilgili bu kişisel veriler, Bakanlığımız Bağlı, İlgili ve ilişkili Kurumları ile sizlerin hizmet kalitesini ve memnuniyetini arttırmak amacıyla paylaşılabilmekte olup 6698 sayılı Kişisel Verilerin Korunması Kanunu'nun 28 inci maddesinin ilk fıkrasında yer alan muafiyet halleri saklı kalmak üzere, hiçbir şekilde üçüncü taraflarla paylaşılmamaktadır.
Kişisel Veri Toplamanın Yöntemi ve Hukuki Sebebi
Kişisel verileriniz tamamen otomatik yollarla (bu sistem aracılığı ile) elde edilmekte olup kişisel verilerinizin işlenmesinin hukuki dayanağı, 6698 sayılı Kişisel Verilerin Korunması Kanunu'nun 5 inci maddesinin ikinci fıkrasının (ç) bendi uyarınca veri sorumlusunun hukuki yükümlülüğünü yerine getirebilmesi için zorunlu olması ve (f) ilgili kişinin temel hak ve özgürlüklerine zarar vermemek kaydıyla, veri sorumlusunun meşru menfaatleri için veri işlenmesinin zorunlu olması hukuki sebebine dayanarak işlenmektedir.
İlgili Kişilerin Hakları ve Veri Sorumlusuna Başvuru
Sistem Kullanıcıları 6698 sayılı Kişisel Verilerin Korunması Kanunu'nun 11 inci maddesinde düzenlenen haklarını, 6698 sayılı Kişisel Verilerin Korunması Kanunu'nun 13 üncü maddesi ve Veri Sorumlusuna Başvuru Usul ve Esasları Hakkında Tebliğ hükümleri çerçevesinde Bakanlığa başvurmak suretiyle kullanabilir. Başvurularınızı www.uab.gov.tr/kvkk adresimizde bulunan Veri Sahibi Başvuru Formu’nu, noter kanalıyla veya Kişisel Verilerin Korunması Kurulu tarafından belirlenen diğer yöntemler ile Hakkı Turayliç Caddesi No:5 Emek Çankaya/ANKARA adresine yazılı gönderebilir veya uab@hs01.kep.tr elektronik posta adresine güvenli elektronik imzalı olarak iletebilirsiniz. Talebinize en kısa sürede ve kanuna uygun olarak en geç otuz (30) gün içerisinde geri dönüş yapılacaktır. İşlemin ayrıca bir maliyeti gerektirmesi hâlinde, Bakanlık’ın Kişisel Verileri Koruma Kurulunca belirlenen tarife üzerinden kanuna uygun olarak ücret talep etme hakkı saklıdır.

Clarification Text Regarding ALO 123 System of The Turkish Republic Ministry of Transport and Infrastructure
This Clarification Text is in accordance with the title line nr. 10 that includes ‘’The Duty of Data Controller to Clarify’’ of the Law on the Protection of Personal Data nr. 6698. Within the Law on the Protection of Personal Data, the Clarification Text is provided by T.C Ministry of Transport and Infrastructure (the Ministry) to inform the users of the mobile application (ALO 123) regarding protection of personal data. The address of the Ministry that possesses the title of controller in accordance with the Law on the Protection of Personal Data is ‘’Hakkı Turalyiç St. No: 5 Emek Çankaya/ANKARA’’.
Identity of the Data Controller
T.C Ministry of Transport and Infrastructure is the controller of data that is processed in the system.
The Aim of Processing Personal Data
Name, surname, contact information, gender, disability status, educational status, address, image, and location will be processed by the system for following reasons: To address the users correctly, to verify telephone calls, to identify the calls statistically, to track reports from citizens, to conduct/supervise/analyze/report and monitor activities concerning, to track requests and complaints, to conduct activities regarding information and inquiry, to keep available necessary information in case of new request, to identify location in case of emergency, to ensure process security of those providers and receivers of service, to carry out necessary service, and to use for possible disputes as a proof. All the information stated above will be used according to statute indicated by the Law on the Protection of Personal Data. Information concerning location will be only used instantly ;therefore, it cannot be recorded. Location data cannot be processed if location service is closed.
Transfer of Personal Data
Your request related to your use of our ministry and the application of personal data associated with the institutions to increase the quality of your service and satisfaction, whether Law No. 6698 on the protection of personal data can be shared in the first paragraph of Article 28 of the exemption to the state, without prejudice in any way will not be shared with third parties.
Methods of Collecting Data and Legal Basis
Personal data is obtained by fully automatic means (via this system), and the legal basis for the processing of personal data is that it is mandatory for the data controller to fulfill its legal obligation pursuant to subparagraph (ç) of the second paragraph of Article 5 of the Law on the Protection of Personal Data No. 6698 and (f) provided that it does not harm the fundamental rights and freedoms of the data subject, data processing is mandatory for the legitimate interests of the data controller, based on the legal reason.
Rights of Relevant Persons and Application to Data Controller
System Users can exercise their rights set out in Article 11 of the Personal Data Protection Law No. 6698, by applying to the Ministry within the framework of the provisions of Article 13 of the Personal Data Protection Law No. You can send the Application Form in writing to Hakkı Turayliç Street No:5 Emek Çankaya/ANKARA via a notary public or other methods determined by the Personal Data Protection Board, or send it to uab@hs01.kep.tr electronic mail address with secure electronic signature. Your request will be responded to as soon as possible and in accordance with the law, within thirty (30) days at the latest. In the event that the transaction also requires a cost, the Ministry reserves the right to charge a fee based on the tariff determined by the Personal Data Protection Board in accordance with the law.
